Minchin & Kelly participates in the Diacore Gaborone Marathon

On Sunday, April 27th, our Minchin & Kelly team hit the roads of Gaborone with unstoppable energy! Staff members boldly pounded the terrain across various categories in the Diacore Gaborone Marathon – from the full 21km challenge to shorter races – showcasing grit, teamwork, and that unbeatable Botswana spirit.

We were graced by the leadership participation of our two Firm Partners: Nyaradzo Mupfuti (Partner & Head of Financial Recoveries) and Tatenda Dumba (Partner & Head of Banking & Project Finance), who both conquered the 10km. Shoutout to the only female team member Chibuya Mphinyane who boldly stretched her limits and ran the full 21km – true trailblazer!

Proud of every step they took! Whether crossing finish lines or cheering from the sidelines, it’s moments like these that remind us that endurance isn’t just for races but it’s how we tackle every challenge in business and beyond.

During the reception, our Managing Partner, 𝐓𝐞𝐫𝐞𝐧𝐜𝐞 𝐃𝐚𝐦𝐛𝐞, delivered remarks on DLA Piper’s extensive and in depth expertise in the legal and regulatory aspects of mining projects across Africa. As a firm, we remain committed to guiding clients through complex, cross border mining matters with a strong foundation of technical excellence and a deep understanding of the African regulatory landscape.

A key theme emphasised in Mr. Dambe’s address was the imperative that the importance of mining not only being for profit, but must also be for the benefit of the peoples and communities of Africa.

We were also pleased to hear from other distinguished speakers, including 𝐇𝐨𝐧. 𝐏𝐚𝐭𝐫𝐢𝐜𝐢𝐚 𝐃𝐞 𝐋𝐢𝐥𝐥𝐞, South Africa’s Minister of Tourism.

Celebrating Collaboration: Stanbic Bank Botswana’s Legal and Governance Activities

As part of our continuous outreach to inform clients on various aspects of the law, the firm participated in two events hosted by Stanbic Bank Botswana Limited.

On the 22nd October 2025, our Head of Corporate and Commercial Isaac Ntombela and Victor Chilembwe, an associate in the Corporate and Commercial Department, accompanied by our Managing Partner Terence Dambe, made a presentation at the Stanbic Bank Botswana board strategy session, on compliance with the Data Protection Act, specifically on penalties that are leviable under the Act and related legislation, including how these are interpreted and potentially determined. In today’s digital economy, understanding this regulatory landscape is not just a legal requirement but a core strategic imperative.

Last Friday, 24th October 2025, Attorneys Victor Chilembwe and Obakeng Keith Mmopi had the pleasure of representing our firm at the Bank’s inspiring Legal and Governance Day.

We embraced the day’s spirit of collaboration, engaging in meaningful conversations with numerous visitors at our stall. In line with a wonderful new initiative, we were delighted to offer pro bono legal services to walk-in clients, reinforcing our commitment to accessible legal support.

Empowering Innovation Through Human-Centered Design: Reflections from The Engineering Forum 2025

Last week, Minchin & Kelly (Botswana) had the privilege of participating in the esteemed Engineering Forum 2025, hosted by the Engineering Regulatory Board Botswana. Our Associate, Victor Chilembwe, presented a compelling legal perspective on Human-Centered Design: Engineering with Empathy, a topic that resonates deeply with our firm's commitment to providing innovative legal solutions.

Human-centered design is more than just a design philosophy; it is a transformative approach that places empathy at its core. By understanding and relating to the needs and experiences of communities, engineers can create solutions that not only meet functional requirements but cater to environmental, social and governance needs of the society. This empathetic approach ensures that projects are developed and implemented with the well-being of people as the primary focus, fostering a sense of inclusivity and community engagement.

Victor emphasized the critical role of community engagement in the project development process. By actively involving stakeholders, engineers can ensure that their designs are not only technically sound but also socially relevant and sustainable. This collaborative approach helps in identifying and addressing potential challenges early on, leading to more effective and impactful solutions. Moreover, integrating Environmental, Social, and Governance (ESG) principles into engineering practices ensures that projects align with sustainability goals, ethical business conduct, and long-term societal benefits. Prioritizing ESG fosters resilience, minimizes environmental impact, promotes social equity, and upholds governance standards, ultimately driving responsible innovation and lasting positive change in the communities served

In his presentation, Victor also underscored the importance of adhering to legal standards in engineering practices. The consequences of non-compliance can be severe, affecting not only the reputation of engineers but also the safety and trust of the communities they serve. As legal advisors, we recognize the need for robust policies that guide engineers in their mandate, ensuring that their work is both innovative and legally sound.

This discussion highlighted a pressing need to improve the regulatory framework to ensure that Human-Centred Design: Engineering with Empathy principles are not merely theoretical but are embedded in the legislative framework, policy and in practice. By strengthening legal frameworks, engineering standards can evolve to reflect real-community needs, reinforcing a culture of ethical responsibility and meaningful societal impact. Our Corporate and Commercial division successfully held a Data Privacy Awareness Day on Friday the 26^th of January 2024 in observance of the International Data Privacy Week. Our team eagerly informed the public about their rights as data subjects and thoroughly engaged on the practical aspects of how their data is currently being obtained and how to ensure that their data is secure.

Bokamoso Private Hospital Wellness Day Commemoration

On Friday the 15^th of September 2023, our Head of the Financial Recoveries division Nyaradzo Mupfuti together with our Agang Mfolwe, were invited by Bokamoso Private Hospital to speak at their Wellness Day Commemoration. The topic was “Financial Health from a legal perspective” and our team highlighted their experience handling debt collection matters and the legal process thereof.

Debt is a factor that can affect one’s financial health. Our team discussed how the negative effects of debt can be mitigated.

Chats Foundation Wellness Day

This past weekend Team M&K (also known as Team Mufasa), participated in the annual Chats Foundation Wellness Day, an event hosted by the Chats Bua Le Nna Foundation dedicated to raising awareness on gender-based violence and providing support to victims and organizations tackling GBV in Botswana.

There’s nothing quite like the atmosphere of good fun and a little bit of healthy competition to bring about a sense of team spirit and boost morale!

We’d like to thank the Chats Bua Le Nna Foundation for including us in the event and their fight against GBV.

We stand together with all the victims of gender-based violence as we fight for a better future.

Insurance Litigation Seminar

This past Friday we had the pleasure of hosting an insurance seminar for our esteemed clients, practising as insurers. At the seminar we discussed every day practical issues that are encountered in the insurance industry such as insurance litigation, the concept of subrogation and that of time bar. The goal, in discussing these practical issues, was to facilitate the handover of claims and streamline the process of communication between us, Minchin & Kelly (Botswana), and our clients, so as to improve our attorney-client relationship. We have no doubt that this will result in the advancement of our ability to represent our clients diligently in the insurance landscape.
