Real Estate Division


Our Real Estate Division has extensive experience in property law in Botswana. Historically, the firm registered the country’s first title deed at the Deeds Registry in 1891 and the first privately-owned township in the early 1990s.

We were lead counsel for the Morupule Coal Mine for the financing of the expansion of its coal mine to supply the new 600 MW Morupule Coal Power Station, which transaction was the biggest project finance transaction ever undertaken in Botswana. More recently, we registered the biggest mixed use property development in Botswana as a sectional title scheme. 

We also engaged with the Registrar of Deeds to reach consensus on and approval for the securitization of debt by way of registration of security for syndicated funding via Special Purpose Vehicles.  We are on the legal panels of most of the major banks in Botswana. The department is headed by the Managing Partner of the firm, Terence Dambe.

High Profile Transactions

  • Registration of the largest mixed use (offices, retail and commercial) sectional title in Botswana  for Smart Partnership Enterprises (Proprietary) Limited.
  • Creation of the mine rehabilitation trust for Morupule Coal Mine Limited.
  • Providing property and securitization legal advice for the Marubeni Corporation / Posco Energy consortium for the construction, operation and maintenance of a proposed 600MW coal power station in Palapye, Botswana.
